Hesperia woman killed by suspected DUI driver on Highway 138



PHELAN, Calif. ( – A 47-year-old Phelan man was arrested on felony DUI and manslaughter charges after a fatal head-on crash on Highway 138 west of Evergreen Road on Monday afternoon.

According to the California Highway Patrol, Gary Scott Ackerman, was traveling west on SR-138 when he veered into opposing lanes of traffic at around 1:30 p.m., colliding into a Chevy pickup with three occupants.

Following the impact, the tan GMC pickup overturned onto the south dirt shoulder and the white Chevy pickup came to rest across both the westbound and eastbound traffic lanes. Officials confirmed, they received reports about the GMC driving recklessly prior to the collision.

The right front passenger of the Chevy, identified as Delmy Mejia Viera, 41, of Hesperia sustained fatal injuries and was pronounced dead at the scene by paramedics at 1:45 pm. The driver and passenger were airlifted to trauma centers with life threatening injuries.

The driver of the GMC pickup, Gary Ackerman, was placed under arrest for driving under the influence of alcohol, before being transported by ground ambulance to Loma Linda University Medical Center to receive treatment for his injuries.

“Ackerman will face charges of felony driving under the influence of alcohol causing injury and gross vehicular manslaughter while intoxicated,” CHP officials said in a news release.
