CHP Warns Drivers: Unsecured Loads Pose Road Hazards, Liability Remains Despite Posted Signs
CALIFORNIA (VVNG.com) — The California Highway Patrol is reminding motorists that unsecured loads continue to create dangerous roadway conditions and that posted warning signs do not remove driver responsibility.
“When loads are not covered or contained, debris can fall or blow into the roadway, creating hazards for other drivers,” stated the CHP Golden Gate Division via Facebook.
Authorities emphasized that signage displayed on vehicles, such as warnings claiming no responsibility for damage, does not protect drivers from liability.
“Posting signs claiming no liability does not remove responsibility. Drivers are required to ensure their load is secured so that nothing escapes from the vehicle,” CHP stated.

California law reinforces that requirement. Under California Vehicle Code §23114, drivers must properly secure loads to prevent materials from “dropping, spilling, or otherwise escaping” onto the roadway. Additional sections, including §23115, require loads such as dirt, sand, or gravel to be covered, while §24002 prohibits operating a vehicle in an unsafe condition — which can include transporting unsecured material.
The agency noted that both personal and commercial drivers are responsible for properly securing materials before traveling on public roads.

“Whether it’s a personal project or a commercial haul, taking a few extra minutes to properly secure your load helps keep everyone on the road safe,” the statement added.
CHP officials said enforcement efforts will continue to target violations involving unsecured loads in an effort to reduce preventable hazards and improve roadway safety for all motorists.
